Second B.D.M.I.A. 2012 Board of Director's election proxy's (ballots) to be mailed by January 27, 2012


As you know, the first contested B.D.M.I.A. election in its 40 year history has resulted in a mailing fiasco with many owners not receiving ballots or receiving ballots with the wrong name due to a "computer glitch", we were informed by the B.D.M.I.A board at last Wednesday's B.D.M.I.A. meeting. Thank you to everyone who attended that meeting. We have insisted that the mailing be resent and the annual meeting be postponed to February 28th so that all owners who want to vote for a new board of directors, will have the opportunity to cast their vote.

S.C.A.M.D.

We are some of your neighbors who are against the proposed development on the Mizner Trail fairways. Many of us have the experience of spending 5 years fighting the last proposal to develop the golf course and now are organizing to defeat the Siemens proposal.  The name of the coalition is:  Second Coalition Against Mizner Development or S.C.A.M.D. (scammed, get it?).

We are a Florida Non Profit organization, registered with the State, Florida N10000009200. We have hired a specialized attorney, Ralf Brookes, to represent the interests of the homeowners. Mr. Brookes has worked with many other grassroots organizations to defeat developers. Defending our community from wealthy developers with deep pockets who are poised to make millions does not come cheap. We need your financial support; all donations are tax deductible. Reasons For Our Opposition

1. The change of zoning from open space / golf course to residential and the construction of townhouses will; create suburban sprawl, increase density, increase traffic, add students to our already crowded schools, reduce the aesthetics of the community, lower the standard of living and quality of life in Boca Del Mar life that the current zoning provides by replacing the open green space with new townhouses and roads.

2. Mizner Trail is zoned open space / golf course for perpetuity as confirmed in the 2005 Palm Beach County Planning & Zoning report. As Eric McClellum, the Planning & Zoning project manager who reviewed the previous smaller plan in 2005 stated, "It's not merely a golf course, but a passive and scenic view-shed and natural boundary. Mizner Trail is a functionally, holistic, integrated part of the Boca del Mar Community."

3. The zoning change would be nothing less than a governmental financial bailout for the wealthy golf course owner who failed to operate a profitable business due to his own poor business decisions. As Commissioner McCarty stated, "We're here due to the poor decisions of the golf course owner. It's not the county's responsibility to bail him out."

4. Its seems obvious that townhouses and roads, forty feet from our property line replacing open green space will devalue our property. Homeowners have a right to be compensated for the devaluing of their property due to the deliberate actions of the government. As Commissioner Masilotti stated, " I am concerned about homeowners suing the county for the devaluation of their property due to the changes in zoning."

5. The smaller plan to build 287 townhouses was rejected by the Palm Beach County Planning & Zoning Department, The Palm Beach County Commissioners voted unanimously against any development, and Circuit County Court Judge Jonathan Gerber ruled that the County had acted in the best interest of the community as a whole by denying the zoning change. Judge Gerber wrote, "The County, through its staff and commissioners, weighed the advantages and disadvantages and in the best interest of protecting the welfare of the surrounding neighborhoods, denied Mizner's application to change the 43 acres use from golf course to residential."

6. The Siemens Group's proposal has created uncertainty in a fragile real estate market because homeowners who are currently selling their homes must disclose that there is a proposal to build 390 townhouses forty feet from their property line. The mere proposal itself hinders sales further in an already depressed market further driving down real estate prices.

In its current state, the Mizner Trail Golf Course is an eyesore, but we are not limited to choosing between looking at a run down, abandoned golf course or housing. There are options. There are choices.

We have 2 goals -

1. To prevent the zoning change and stop any development on the fairways

2. To help find a long-term solution for the golf course that will enhance the value and quality of life in our community
